Notice Period Rules in India: Last Working Day, Buyout and Early Release

Resigning from a job in India starts a countdown: the notice period. How long is it, is it counted in calendar days or working days, can you leave early, and how much will a notice period buyout cost? What Is a Notice Period?

A notice period is the time between telling your employer you are leaving (resigning) and your final day at work. It gives the company time to find a replacement and lets you hand over your work. The length is set by your appointment letter or employment contract, and for some workers by the company's certified standing orders.

There is no single law that fixes a notice period for all private-sector employees. What your contract says is what applies, as long as it is reasonable.

How to Calculate Your Last Working Day

Most Indian companies count notice in calendar days, starting the day after you resign:

Last working day = Resignation date + Notice period (in days)

Example: 60-day notice

You resign on 1 October 2026 with a 60-day notice period. Counting 60 calendar days from 2 October, your last working day is 30 November 2026.

Example: 90-day notice

Resigning on 1 October 2026 with 90 days' notice gives a last working day of 30 December 2026.

Notice in months

If your contract says "one month" or "three months", count calendar months: resigning on 15 October with one month's notice usually means a last day of 15 November. Some companies count the resignation day itself as day 1, which moves the last day one day earlier – check your HR policy.

Calendar Days vs Working Days

A few contracts specify notice in working days, which excludes weekends and holidays and makes the notice period longer on the calendar. Thirty working days (Monday to Friday) is about six calendar weeks. Unless your contract clearly says working days, assume calendar days – that is the norm in India.

Notice Period Buyout

If you want to leave before completing your notice – often because a new employer wants you to join sooner – you can ask to buy out the remaining days. The usual formula is:

Buyout amount = (Monthly salary ÷ 30) × Unserved notice days

Example: your monthly salary (as defined by the policy, often basic or gross) is ₹60,000 and you leave 20 days early. Buyout = ₹60,000 ÷ 30 × 20 = ₹40,000. Some companies use 26 working days instead of 30, or basic salary instead of gross. Your new employer may agree to reimburse the buyout – ask during the offer negotiation.

Early Release and Garden Leave

  • Early release: your manager and HR may relieve you before the full notice ends if your handover is complete. Always get this in writing.
  • Adjusting leave: some companies allow you to adjust earned leave against notice days; many do not, and instead pay out (encash) unused leave in the full and final settlement.
  • Garden leave: the employer asks you not to come to work but continues to pay you until the notice ends, often to protect confidential information.

Can You Take Leave During the Notice Period?

Many employers restrict leave during notice because it delays the handover, and some extend the last working day by the number of leave days taken. Sick leave with a medical certificate is usually allowed. Check your leave policy before planning time off.

Full and Final Settlement

After your last working day, the company pays your full and final (F&F) settlement: salary for days worked, encashment of eligible unused leave, any pending reimbursements and bonuses, minus recoveries such as notice shortfall or company property not returned. Under India's Code on Wages, wages due on resignation are meant to be paid within two working days, though many companies still take 30–45 days as per their policy. Gratuity is payable if you have completed five years of continuous service. You should also receive a relieving letter and an experience letter, and your PF can be transferred to the new employer through the EPFO portal.

Notice Period for Government Employees

Permanent central government employees usually give notice of three months for voluntary retirement or resignation, and temporary employees one month, subject to acceptance by the competent authority. How to Write a Resignation Email

Keep it short, polite and clear:

  • Say that you are resigning and state your position.
  • Mention your notice period and proposed last working day.
  • Offer to help with the handover.
  • Thank your manager and team.

Send it to your reporting manager and copy HR, and keep a copy for your records.

  • Negotiate the joining date with the new employer based on your real last working day.

When the Employer Ends the Job

Notice works both ways. If your employer terminates your employment (other than for proven misconduct), your contract usually requires the company to give you the same notice period or pay salary in lieu of notice. For workers covered by industrial relations law, retrenchment generally requires at least one month's notice or pay instead, along with retrenchment compensation. Senior managers and professionals are governed mainly by their contracts. Always ask for the termination terms in writing.

How to Negotiate a Shorter Notice Period

  • Offer a strong handover – documented processes and a trained replacement make early release easier to approve.
  • Adjust pending leave where the policy allows.
  • Offer to be available by phone or email for a few weeks after leaving for questions.
  • Ask your new employer to reimburse a buyout if they need you sooner.
  • Talk to your manager first, then HR, and confirm any agreement by email.

  • Last three payslips and the full and final settlement statement.
  • Form 16 for the financial year (issued by June for the previous year).
